GENERAL CONDITIONS OF SALE
These general conditions of sale govern the sale of products and, where applicable, services carried out through the site www.pipinato.com .
By placing any order or purchase the Customer implicitly and fully accepts these general conditions of sale, for this reason the Customer is invited to read them carefully before making reservations and/or orders through the Site.
1. DEFINITIONS
In these general conditions of sale (hereinafter also "GTCS"):
"Client” means any person or company who has or has not completed the registration process and created an account. who purchases and/or intends to purchase one or more products and/or services through the Site as a professional.
"Pipinato footwear” means PIPINATO CALZATURE SPA, with registered office in via Francesco Scipione Orologio 3, 35129 Padua (PD), tel.: 049 775233, e-mail: customerservice@pipinato.com registered in the Padua Company Register, registration number, tax code and VAT number. 02392690281.
"Warehouse or collection point” means the headquarters of the sorting center located in via Francesco Scipione Orologio 3, 35129 Padua.
"Business day(s).“: means every day of the week with the exception of Sundays and other nationally recognized holidays.
"Services“: means the free or paid offer of the products and/or services present on the Site, not only the physical delivery or distribution of products (e.g. product booking services; additional after-sales assistance services), but also the offer of services related to the information society (e.g. profiled newsletters or other forms of online advertising) related to online purchases.
To use the services offered on the Site www.pipinato.com you must create an account by registering on the Site at www.pipinato.com/it/customer/account/login . The Customer is required to keep his account and his access password confidential, as well as to control access to his electronic devices: he is also responsible for any activity carried out with his account.
2. APPLICABLE LAW
The contract for the sale of products and services concluded through the Site is governed by these general conditions of sale and by law.
It is specified that the offer of products and/or services present on the Site is addressed exclusively to professionals, that is to say to natural or legal persons acting in the exercise of their entrepreneurial, commercial, artisanal or professional activity, therefore Pipinato footwear reserves the right not to accept orders from parties who do not have this capacity.
The contract with which the Customer chooses to order, purchase and pay through the Site for one or more six products and/or services present on the Site which the Customer chooses to receive directly at his home is concluded online.
These general conditions of sale apply to the sales contract concluded online.
3. OFFERING OF PRODUCTS AND SERVICES ON THE SITE
The presentation of products and services that can be purchased through the Site constitutes an invitation to offer; once the desired items have been selected, the Customer can close the cart and send the order to Pipinato using the "send the order".
This sending will therefore be considered a contractual purchase proposal (hereinafter "Order“) of the Customer subject to confirmation or acceptance by Pipinato footwear as described below.
4. CONFIRMATION OF RECEIPT OF THE ORDER AND RELATIVE ACCEPTANCE
Pipinato footwear will confirm receipt of the Order with an email containing the identification number assigned to the Order. This confirmation will not be valid as acceptance of the Order, but as mere confirmation of acceptance of the same, except as indicated below.
In the case of a product "available" (i.e. physically present in the warehouse) Pipinato footwear will send a "order confirmation and shipping email” which will be valid as acceptance of the Customer's purchase proposal referred to in the Order with consequent conclusion of the sales contract. In this email, in addition to a summary of the goods purchased and their price, the payment and shipping methods are also indicated. In the event that the Customer has chosen to pay by bank transfer, Pipinato footwear will only send the goods once the payment has been successful.
In the event that the customer does not pay the sum within the indicated times, the order will be canceled immediately, which will be communicated via email from Pipinato calcio ("partial order cancellation/confirmation email").
Advance payment on the site by credit or prepaid card cannot be understood as the conclusion of the contract which will be finalized only when the "email" is sent.order confirmation and shipping".
In the event that the product is not physically available in the Pipinato footwear warehouse, it will send a "partial order cancellation/confirmation email” which will contain the changes made to the order. This email will not be considered acceptance of the offer, therefore the contract is not concluded. A "will follow"order confirmation and shipping email” which will be valid as acceptance of the Customer's purchase proposal referred to in the order with consequent conclusion of the sales contract.
5. UPDATE REGARDING THE STATUS OF THE ORDER
Except for updates that may be sent by Pipinato footwear via email, the Customer can check the status of their Order at any time also in the dedicated section of the Site.
6. ACCEPTED PAYMENT METHODS
The products purchased by the Customer through the Site can be paid alternatively with:
- credit card;
– PayPal;
- bank transfer;
– in cash at the courier or at the collection point.
7. SHIPPING COSTS
An amount for shipping and transport costs will be added to the price of the product purchased by the Customer through the Site. This amount is automatically calculated by the system and will be indicated in the Order before it is sent by the Customer.
Shipments abroad are normally entrusted to the courier. The shipping cost, calculated both on the basis of weight and the country of destination, is automatically displayed in the cart during the purchase process and indicated in the Order before it is sent by the Customer.
8. PRICES
The prices of the products presented on the Site and indicated in the technical data sheets of each product are net of VAT and any other taxes.
Should the goods be delivered outside Italy, customs costs and import taxes will be borne by the Customer.
prices do not include any transport costs and/or costs for other additional services requested by the Customer.
Given that the price of the products indicated on the Site and viewable by the Customer when choosing the product and/or service will be the one in force at the time the Order is sent by the Customer and will correspond to the purchase price of the product ( therefore there will be no change in the price once the order has been forwarded by the Customer), it is specified that Pipinato footwear reserves the right to modify at any time, at its sole discretion and without notice, the price of the products and/or services present on the site.
Pipinato footwear therefore does not provide any guarantee that the selling price of the products or services will remain unchanged for a certain period of time.
9. DESCRIPTION OF THE PRODUCTS
Each product sheet on the Site contains a description of its functions and characteristics (size, colour, equipment, etc.), based on the information provided by the Manufacturer of the goods in its catalog or otherwise communicated to Pipinato footwear.
Pipinato calcio therefore has no responsibility for any errors and/or inaccuracies present in the technical data sheets, nor for any defects in correspondence between the description of the product and the actual functions and characteristics of the same.
The images and photos used to accompany the product technical data sheets are merely indicative and may not be perfectly representative of the characteristics of the goods, as they may differ in colour, size or accessories.
by submitting the Order the Customer expressly accepts the foregoing.
10. PLACE OF DELIVERY OF THE PRODUCTS
Pipinato footwear will deliver the goods (product and/or service) purchased to the address indicated by the Customer on the site.
Pipinato calcio is not responsible for non-delivery of the product and/or service purchased caused by errors by the Customer in indicating the address (e.g. lack of house number, unknown address, incorrect address, etc.).
11. DELIVERY TIMES
The products indicated as "available" will be delivered within the deadline indicated in the order shipping confirmation email. In any case, the term should not be considered essential.
Pipinato footwear does not deliver on Saturdays, Sundays and holidays.
In the event of the purchase of multiple products of different types, Pipinato footwear reserves the right to deliver them at different times. This choice will not entail any increase in costs for the Customer.
12. VERIFICATION OF THE PRODUCTS BY THE CUSTOMER
Upon receipt of the purchased product, the Customer is required to verify whether:
(i) the number of packages delivered corresponds to that indicated on the transport document:
(ii) if the packaging is externally intact.
Acceptance of delivery of the products without the Customer having raised a reservation or dispute in the transport document is equivalent to recognition of the conformity of the delivery with the Order in terms of quantity, type and packaging. The additional guarantees provided for by law in relation to the products delivered remain unaffected.
13. BILLING
Sales of goods are subject to the obligation to issue an invoice, therefore when placing the Order the Customer must indicate the precise data for issuing the electronic invoice. The electronic invoice will be available in the reserved area of the Revenue Agency website or at the PEC address communicated by the Customer; a courtesy copy of the invoice will be made available to the Customer in the personal area (where it can be consulted and downloaded in PDF format).
14. NON-AVAILABILITY OF A PRODUCT
Pipinato footwear undertakes to do everything possible to satisfy the Customer and to quickly and effectively process the Order sent through the Site.
However, if the product indicated on the site as "available" is no longer available, due to exceptional and unforeseeable events, Pipinato calcio will promptly notify the Customer via email or telephone. Any refunds will be available as store credits for the purchase of other products on the Site.
15. HOW TO STORE THE CONTRACT
Pursuant to art. 12 of the Legislative Decree. 70/2003, Pipinato calcio informs the Customer that each order sent is stored in digital/paper form on the server at the Seller's headquarters according to confidentiality and security criteria.
16. COMMUNICATIONS, CONTACTS AND COMPLAINTS
For any request, communication or complaint relating to reservations or orders, to these GCS or, in general, to any contract concluded through the Site, you can contact the Company at the following email: customerservice@pipinato.com .

17. JURISDICTION AND COMPETENT COURT FOR DISPUTES
These General Conditions of Sale and the contract concluded with the Professional Customer are governed by Italian law.
All disputes relating to the validity, effectiveness, interpretation or execution of these GCS, of the sales contract as well as, in general, relating to navigation on the Site by the Customer or to the use of any functionality made available to him on the Site, are competent exclusively the Judicial Authority of the Court of Padua.
